DUI Field Notes

The Question

  • Is there a legal ruling or documentation that indicates as investigators we are allowed to discard/keep our field notes (notes taken during DUI or any field investigations)?

Options

  1. Transpose and retain notes for court as part of the states “discovery” materials
  2. Transpose and destroy

Be prepared to answer questions regarding either option.
